Terms of Service - CometWeb Insight
1. General Provisions
These Terms of Service govern the use of CometWeb Insight – a comprehensive website analysis platform covering performance, SEO, accessibility, security, and digital ecology.
The Service is operated by Maciej Zmitrukiewicz, a sole trader operating under the unregistered-business regime (działalność nierejestrowana — Polish Entrepreneurs' Law Art. 5(1)) under the brand "CometWeb", based in Wrocław, Poland. CometWeb is the product brand, not a separate company.
Contact details:
- Email: maciej@cometweb.io
By using the Service, you accept these Terms. You also confirm that you have received the information in our Privacy Policy (this is not consent to all processing — legal bases under the GDPR are set out in the Privacy Policy). Documents may change under the rules described in section 10.
2. Definitions
- Service – CometWeb Insight platform available at app.cometweb.io
- User – natural or legal person using the Service
- Account – User's individual account in the Service
- Analysis – report generated by the Service for a specified website
3. Registration and Account
To use the full functionality of the Service, creating an Account is required. During registration, the User must provide:
- Valid email address
- First and last name
- Password meeting security requirements (min. 8 characters, uppercase letter, special character)
The User is responsible for maintaining the confidentiality of login credentials.
The Service may only be used by persons who are at least 16 years old, or by persons acting on behalf of a business or other organisation. By creating an Account, the User confirms that they meet this requirement.
4. Acceptable Use
The User agrees to:
- Only analyze websites they own or have permission to analyze
- Not abuse the Service's resources
- Not attempt to circumvent security measures
- Not process data in violation of applicable laws
- Use comparative features (competitors, SERP, benchmarking) and the crawler only for domains they own or have permission to analyze — crawling third-party URLs without such basis is solely at the User's risk
5. Subscription Plans
The Service offers various subscription plans (Free, Growth, Studio, Scale, Enterprise) with different monthly analysis point allocations. Details are available on the pricing page.
6. Intellectual Property
All rights to the Service, including source code, analysis algorithms, user interface, and documentation, belong to CometWeb. Analysis results may be used by Users for their own purposes.
7. Disclaimer and Limitation of Liability
Consumer reservation. This clause 7 applies only to Users who are not consumers (B2B). As against consumers and sole traders with consumer status, nothing in these Terms excludes or limits rights arising from mandatory law — in particular Chapter 5b of the Polish Consumer Rights Act (conformity of digital content and services, and the remedies of repair, price reduction and withdrawal) and the Civil Code. Where there is a conflict, statutory rules prevail.
The Service is provided "as is" and "as available," without warranties beyond those arising from mandatory law.
7.1. No Warranty of Results
CometWeb does not warrant the accuracy, completeness, or timeliness of analysis results. Results are for informational purposes only and do not constitute professional technical, legal, or business advice. CometWeb does not guarantee improvement in search engine rankings, performance scores, accessibility metrics, or compliance with any laws or regulations.
7.2. No Warranty of Availability
CometWeb does not guarantee uninterrupted, error-free operation of the Service or security from all threats. The Service may be temporarily unavailable due to maintenance, outages, or other circumstances.
7.3. Exclusion of Damages
To the maximum extent permitted by applicable law, CometWeb shall not be liable for:
- Any direct, indirect, incidental, special, or consequential damages
- Loss of profits, revenue, data, or goodwill
- Business interruption
- Cost of procuring substitute services or products
- Damages arising from decisions made based on analysis results
The above exclusions apply regardless of the legal basis of the claim (contract, tort, statute) and even if CometWeb has been advised of the possibility of such damages.
7.4. Limitation of Liability
CometWeb's total aggregate liability to the User for all claims arising from or related to the Service shall not exceed the fees actually paid by the User during the 12 months preceding the event giving rise to the claim. This cap does not apply to consumers or sole traders with consumer status, and does not cover intentional damage or personal injury — for those we are liable under general rules.
7.5. Third-Party Websites
CometWeb is not responsible for the content, security, availability, or operation of websites analyzed by the Service. Analyzing a third-party website without the owner's consent is solely at the User's risk.
7.6. Force Majeure
CometWeb shall not be liable for failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, cyberattacks, third-party infrastructure failures, governmental actions, or other force majeure events.
8. Artificial Intelligence Systems
8.1. Use of AI Systems
The Service uses artificial intelligence (AI) systems to generate analyses, recommendations, code fixes, reports, and chat responses. AI-generated results are for informational purposes only and do not constitute legal, technical, or business advice.
8.2. AI Model Providers
The Service uses third-party large language model (LLM) providers: OpenRouter as the primary gateway (not exclusive) to models, including DeepSeek and Perplexity only as OpenRouter slugs (no direct api.deepseek.com), and OpenAI — including direct api.openai.com for project/third-party context after privacy rewrite. Current list: /about-ai. Data processing by providers is governed by their privacy policies and data processing agreements (DPA).
8.3. AI Limitations
AI systems may generate inaccurate, incomplete, or outdated content. Users should verify all AI results before acting on them. CometWeb is not liable for damages resulting from unverified AI outputs.
8.4. AI transparency (EU AI Act)
The Service implements specific transparency measures related to Regulation (EU) 2024/1689 (EU AI Act), in particular informing users about the use of AI systems in the application interface. This statement is not a global claim of complete compliance with every AI Act obligation; role classification (provider/deployer) and remaining duties are subject to a separate assessment.
8.5. Human Oversight
All AI-generated recommendations require user approval before implementation. The AI system does not make automated decisions affecting the legal status or interests of natural persons.
8.6. Reporting AI Issues
If you encounter incorrect, harmful, or inappropriate AI-generated results, please report the issue to: maciej@cometweb.io.
9. Termination and Account Deletion
Users may delete their Account at any time in Service settings (Profile or Settings → Privacy & data) or by contacting maciej@cometweb.io.
9.1. Account deletion process
- After confirmation the Account is marked for deletion (soft-delete); active sessions are terminated immediately.
- Permanent erasure of personal data and projects occurs after 30 days, unless mandatory law requires a different period.
- Before deletion, Users may download a copy of their data (GDPR Art. 15 and 20) via Settings → Privacy & data (maximum once every 24 hours).
- CometWeb sends a confirmation email stating the scheduled date of permanent deletion.
- Consent records may be retained longer only where required by law or to defend against claims (see Privacy Policy).
9.2. Suspension by the operator
CometWeb reserves the right to suspend or delete Accounts in case of Terms violation, including analyzing websites without a required legal basis or abusing Service resources.
10. Changes to Terms
CometWeb reserves the right to modify these Terms. Users will be notified of significant changes via email 14 days in advance.
11. Payments and Subscriptions
Selected features are paid under subscription plans. Prices, plan scope and the billing cycle (monthly or annual) are set out in the pricing page. The total payable is displayed before payment is confirmed. Payments are handled by an external payment provider — we do not store full card details. Subscriptions renew automatically unless cancelled before the end of the current period; cancellation ends access at the end of the paid period and no further charge is taken. Sales documents and payment history are available in the billing portal (Stripe Customer Portal) in your account settings, and on request at maciej@cometweb.io.
12. Right of Withdrawal (Consumers)
A consumer (and a sole trader using the Service for non-professional purposes) may withdraw from the contract within 14 days without giving a reason, by emailing maciej@cometweb.io. The Service is a digital service. Starting to use a subscription does not itself remove the right to withdraw. If the consumer expressly requests performance within 14 days and receives the required information, withdrawal may require payment of the proportionate cost of the service already provided. We do not charge this cost without that request or the required information. The right can expire only after full performance and fulfilment of the statutory conditions. This does not apply to businesses contracting in connection with their professional activity.
Model withdrawal form (matching Annex 2 to the Polish Consumer Rights Act — using it is optional):
To: Maciej Zmitrukiewicz (CometWeb) maciej@cometweb.io I/We(*) hereby give notice that I/We(*) withdraw from my/our(*) contract for the supply of the following service(*): ............................................................................. Date of contract(*)/receipt(*): ................................ Name of consumer(s): ........................................... Address of consumer(s): ........................................ Signature of consumer(s) (only if this form is notified on paper) Date: .......................................................... (*) Delete as appropriate.
13. Complaints
Complaints about the Service or payments may be sent to maciej@cometweb.io with a description of the issue and contact details. We handle complaints within 14 days. Consumers may use out-of-court dispute resolution, including the Provincial Inspector of Trade Inspection (Inspekcja Handlowa), a municipal or district consumer ombudsman, and guidance published by UOKiK. The EU ODR platform was discontinued on 20 July 2025 and is no longer available.
14. Governing Law and Disputes
The contract is governed by Polish law, without prejudice to the mandatory consumer-protection rules of the consumer's country of habitual residence. These Terms do not limit a consumer's statutory rights. Disputes with consumers are settled by the court having jurisdiction under applicable law; disputes with businesses (B2B) by the court competent for the operator's seat.
